TERMS OF SERVICE
Following are the Astarna Inc. Hosting Terms and Conditions. Anyone entering into a contract with Astarna Inc. claims that they are at least 18 years of age and agrees to the terms below. Please read these terms and conditions carefully. It is a condition of your use of the Service that you comply with these terms and conditions.

Astarna Inc. reserves the right to discontinue service or deny services to anyone they feel are in violation of the terms and conditions shown below.

Astarna Inc. Kids services are provided by Astarna Inc. Astarna Inc. Kids hereinafter shall be referred to as Astarna Inc.

MODIFICATIONS TO TERMS OF SERVICE
By using this site, you consent to the collection and use of this information by Astarna Inc. Astarna Inc. reserves the right to change, modify, and/or remove portions of these Terms of Use at any time. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose.

Payment Policy
To set up a new account customers are required to make an initial payment. New accounts will be set up after billing has been processed. Hosting services are automatically renewed on your renewal date unless other arrangements have been made. Astarna Inc. reserves the right to change prices at any time, unless other terms have been agreed upon.

30 Day Money Back Guarantee
If during the first 30 days of hosting you wish for any reason to cancel your hosting plan with us we will refund your money in full. You must notify us before the 30th day of hosting in order to be refunded the money. If you cancel the plan after the 30th day, no refund will be given.

Violations of Terms and Conditions
In the event that we suspend or terminate service due to violation of our Terms and Conditions, we do not issue a refund.

Cancellation
Astarna Inc. reserves the right to cancel service at any time. You may close your account with us at anytime. To ensure you don't get billed for the next payment cycle please send your request for cancellation 15 days prior to the end of your current billing cycle. If the request is not made in advance you may be charged for an additional billing cycle. Any violation of policies which results in extra costs will be billed to the customer. Any account not brought current within 7 days of receiving email notification is subject to cancellation. The customer is responsible for any outstanding balance due to Astarna Inc. If hosting is cancelled, Astarna Inc. will remove any or all web pages from Astarna Inc. server.

DESCRIPTION OF SERVICES
Astarna Inc. service allows the user to create a web site in a pre-defined template. This service is to provide information about the user's family to outside visitors.

Astarna Inc. or you may terminate your account and remove your site from our listings at any time for any reason.

You should be aware that this site is being monitored and may capture information about your visit. If we deem this information to be objective in any form we reserve the right to cancel your account with Astarna Inc. at any time.

User is responsible for backing up all data prior to uploading to the server. Astarna Inc. is not responsible for any data loss; this would include, but not restricted to, server failure, hard drive failure, mis-configurations or general hardware failure.

ACCOUNT INFORMATION
To open an account you must complete the on line registration form. You are required to provide accurate, true, current and complete information. You agree not to impersonate any other person or entity or to use a false name that you are not authorized to use, or use a name that Astarna Inc. feels in any way is offensive.

All templates offered by Astarna Inc. are copyrighted material. Such templates are offered for use to Astarna Inc. users under license only, and are not offered for sale or unbridled use. Such license limits use of Astarna Inc. templates to sites hosted by Astarna Inc. templates may not be transferred to or hosted on another web host or Internet Service Provider.

You will be issued a user name and password to be associated with your account. You are responsible for maintaining confidentiality of your user name and password. You are responsible for any and all activities that occur under your account.

You agree to and understand that you upload or download material at your own risk, you will be solely be responsible for any damage or loss to your material and your computer system or any such loss of data due to users error or Astarna Inc. errors.

MEMBER PRIVACY
Astarna Inc. respects the privacy of its members. Astarna Inc. will not sell, rent, trade or disclose any information that is provided by members. All information will not be made publicly available or sold to a third party.

Users acknowledge and agree that their web site information may be utilized by us. We will not however sell your email address, deliver advertising to the visitors of your site or attempt to contact visitors to your site.

You should be aware that if we are requested by the police or any other government authority investigating suspected illegal activities to provide personal information and or user information but not limited to this, we are entitled to do so.

Astarna Inc. will not be made responsible for unauthorized access to your account. Any alterations made by a third party that are obscene, offensive, or illegal in content are the responsibility of the user to remove this information from the site.

These services are for personal use only. Any unauthorized use of these services will result in immediate termination. Any unauthorized use of these services for commercial use or the resale of any or our services is strictly prohibited. It is prohibited to use these services for any illegal purposes.

We use cookies on our applications to track sessions. A "cookie" is a small piece of data which is sent from a web server to a web browser and stored locally on the user's machine. The cookie is stored on the user's machine but is not an executable program and cannot do anything to the machine. Whenever a web browser requests a file from the same web server that sent the cookie, the browser sends a copy of that cookie back to the server. A cookie can contain information such as user ID, user preferences, etc. You will not be able to access the Control Panel unless your cookies are enabled. If you choose in your preference settings to have the site only accessible by family and friends using a password protected site, your family and friends would need to have their cookies enabled. However if someone was just looking at the site without the site being password protected it would not matter whether their cookies were enabled or disabled.

SPAM
The sending of spam is regarded as abusing our server and policy. The mailer is strictly for personal use for sending updates to family and friends. Astarna Inc. shall have the right to cancel or terminate any service used by the spammer, whether used in sending the spam or not.
Astarna Inc. reserves the right to submit any and all information such as IP address to any party that may be deemed by Astarna Inc. as a service that should be privy to such knowledge, for example ISP(Internet service provider) . The spammer agrees that the spammer shall have no claim against Astarna Inc. for any losses, damages or costs that result from any action that Astarna Inc. may take in its efforts to permit a spam-free use of its services.

DISK SPACE QUOTA
Astarna Inc. offers 150MB of disk space for all their users. Within the user's control panel under Photo Manager there is a current usage amount indicating how much space you have used. If you pass the 100MB of disk space you will no longer be able to add pictures to your web site.

LIABLITLY
Astarna Inc. assumes no responsibility for any errors or omissions in the content of the web site. Astarna Inc. assumes no responsibility for any failures, delays, or interruptions. Under no circumstances will Astarna Inc. be held responsible for incidental, damages or loss including loss of data, interruption of business, even if Astarna Inc. has been made aware of such damages. In addition, we do not represent or warrant that the information on our site is accurate, current, or complete.

PROPRIETARY RIGHTS TO CONTENT
You acknowledge that content, including but not limited to website layout, functionalities, images, data files, text, software, logos, designs, photographs, graphics, or other material is protected by trademarks, copyrights, service marks, patents or other proprietary rights and laws. All information is deemed for personal use only. You may not modify, copy, reproduce, reprint or distribute in any way any content that is owned or controlled by someone else.

Astarna Inc. retains ownership and all rights of our logos, trademarks, software, trade secrets, databases, and themes of our web site.

INDEMNIFICATION:
Each Party (the "Indemnifying Party") agree to defend, indemnify and hold the other Party (the "Indemnified Party") harmless from and against any and all liabilities, losses, damages, costs and expenses including reasonable attorneys fees and court costs associated with any claim or action brought against the Indemnified Party arising from the actions of the Indemnifying Party, including without limitation, for breach of any warranties or representations contained herein, or infringement of any trademark, copyright, or other claim of any kind based upon the sale or use of the Client's web site or application in accordance with this Agreement or upon Contractor's performance of the services hereunder.

Server Abuse

Any Attempt to undermine or cause any harm to a server is strictly prohibited.

Any unauthorized use of other people's accounts or computers is strictly prohibited. This includes the taking of other peoples account information. Whether or not the attacked account or computer belongs to Astarna Inc. will result in some form of action. Results may vary depending on the severity of the attack in the form of a warning, possible cancellation of account or legal action.

Accounts may be terminated that include the following content or which have links to the following content. Absolutely no refunds will be issued if account termination is due to violation of the terms outlined below:

We will not tolerate any illegal activity or content that may be damaging to our servers or other servers on the Internet. The following are strictly prohibited:

  • Displaying any material that exploits children under 18 years of age
  • Displaying pornography and sex-related merchandising as well as links to adult content. This includes sites that may infer sexual content
  • Displaying or providing any offensive material including expressions for bigotry, racism, hatred as well as profanity
  • Displaying or providing data such as pirated software that includes the serial or registration numbers for software programs, storage or transmission of such data
  • Displaying or providing any data on cracker utilities or links to such sites
  • Displaying or providing copyrighted data and links to sites that provide such information
  • Our servers may not be the source for illegal content, unsolicited emailing, bulk emailing, flames, mail bombs, newsgroup spamming, pornographic content, software serial numbers, cracks, warez, and/or anything else determined by Astarna Inc. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. We reserve the right to determine what constitutes violation of these terms.

    Astarna Inc. prohibits the altering, falsifying or removing electronic headers from emails.

    Disclaimer Astarna Inc. shall not be liable for any claim or right to recover damages, including, but not limited to, loss of profit or data, or other similar claims. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Astarna Inc. and its employees, even if we have been specifically advised of the possibility of such damages. Astarna Inc. makes no warranties of any kind, expressed or implied for services we provide.

    Astarna Inc. does not claim that the services we offer will be uninterrupted or error free. Astarna Inc. does not claim that service will be free from external intruders (hackers) or any unauthorized access. We will do our best to insure outside interference will be avoided, but we make no warranties against the possibility

    As a customer of Astarna Inc. you agree to hold Astarna Inc. harmless from any and all claims, liabilities, losses, costs, attorney's fees asserted against Astarna Inc. or anyone affiliated with Astarna Inc.

    You specifically agree that the download or upload of any material through Astarna Inc. services is done at your own risk, and you will be solely responsible for any loss or damage to you images and your computer system or loss of data that my have occurred during an upload or download whether it is by fault of Astarna Inc. or yourself.

    Astarna Inc. shall not be responsible for unauthorized access to or alteration of you data.
    You specifically agree that Astarna Inc. is not liable or responsible for any threatening, obscene, offensive or illegal content or conduct of any other party.

    Servicing Server From time to time Astarna Inc. must perform maintenance on the servers. We will attempt to do so at a time that would affect the least amount of customers. When Astarna Inc. does have to service the server during peak hours, we will do our best to do so in a timely manner.

    Astarna Inc. reserves the right to revise its policies at any time.
